REQUEST FOR RELEASE OF FUNDS On or about December 9, 2021, the OSPCD will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of the Lead-Based Paint Hazard Reduction Grant authorized by Sec. 1011 of the Residential Lead-Based Paint Hazard Reduction Act of 1992 (Title X of the Housing and Community Development Act of 1992, 42 U.S.C. 4852). The Healthy Homes Supplemental funding is authorized under Section 502 of the Housing and Urban Development Act of 1970 (12 U.S.C 1701 z-2). Funding for both programs is provided by The Consolidated Appropriations Act, 2021, approved December 27, 2020 (Public Law 116-260) and the Further Consolidated Appropriations Act, 2020, approved December 20, 2019 (Public Law 116-94). Funding is provided for the Malden Lead Hazard Reduction/Healthy Homes Program, a housing rehabilitation program focused on reducing lead-based paint hazards with a period of performance of November 1, 2021, through May 30, 2025. The program will make funds available to owner-occupant homeowners and investor-owners utilizing HUD’s Lead-Based Paint Hazard Reduction and Healthy Homes Funds. Low and moderate income families with children are the principal beneficiaries of the program. Structures containing lead-based paint hazards will be treated in accordance with both the HUD Guidelines and the Massachusetts Lead Law. The purpose of the grant is to perform lead-based paint and other housing-based health hazard testing and assessments, hazard reduction and clearance of up to 142 dwelling units in Malden. Additionally, up to 107 units will be assisted with Healthy Homes Supplemental Funds with interventions including but not limited to radon assessment and remediation, replacement of lead water service pipes, and electrical repairs. The OSPCD is requesting the release of $3,100,715.00, which includes a healthy homes supplement of $600,000.00, over a period of performance of November 1, 2021, through May 30, 2025. Additionally, the City of Malden is providing a match funds in the amount of $250,100.00. The proposed hazard reduction activities to be funded under this program are categorically excluded from the National Environmental Policy Act requirements, but subject to compliance with some of the environmental laws and authorities listed at §58.5 of 24 CFR Part 58. In accordance with §58.15, a two-tiered environmental review process has been structured, whereby some environmental laws and authorities have been evaluated for the entire City of Malden. Compliance with other applicable environmental laws and authorities will be evaluated prior to funding each individual project. Specifically, the entire City has been evaluated and is in compliance with the following laws and authorities as established in the Tier I review: Airport Hazards, Coastal Barriers Resources Act, Air Quality, Coastal Zone Management Act, Endangered Species Act, Explosive & Flammable Hazards, Farmlands Protection, Noise Abatement and Control, Sole Source Aquifers, Wetlands Protection, Wild and Scenic Rivers Act, and Environmental Justice. In the Tier II review, compliance with the following environmental laws and authorities will be evaluated prior to funding each specific project: National Flood Insurance Program, Contamination and Toxic Substances, Floodplain Management, and Historic Preservation. If an individual project exceeds the threshold for categorical exclusion detailed in §58.35(a), an Environmental Assessment will be completed and a separate Finding of No Significant Impact and Request for Release of Funds will be published. Copies of the compliance documentation worksheets are available at the address below. An Environmental Review Record (ERR) that documents the environmental determinations for each project, and more fully describes the tiered review process cited above, will be available at Malden’s Office of Strategic Planning and Community Development, 215 Pleasant Street, Third Floor, Malden, MA 02148. The ERR will be available for review and may be examined or copied on Mondays, Wednesdays, and Thursdays from 8:00 a.m. to 5:00 p.m., and Tuesdays from 8:00 a.m. to 7:00 p.m. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to knestor@maldenredevelopment.com. All comments received by December 9, 2021, will be considered by OSPCD prior to authorizing submission of a Request for Release of Funds and Environmental Certification to HUD. RELEASE OF FUNDS The OSPCD certifies to HUD that Deborah A. Burke in her capacity as Director of the OSPCD consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the OSPCD to utilize federal funds and implement the Program. OBJECTIONS TO RELEASE OF FUNDS HUD will consider objections to its release of funds and this certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if the objections are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the OSPCD; (b) the OSPCD has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the OSPCD has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and may be addressed to HUD as follows: Karen M.
