THE MALDEN ADVOCATE–Friday, September 4, 2026 Page 19 MUSINGS | FROM PAGE 19 Viva Dom! Postscript 2: Wait! Who is that crawling out from under the fryolator?! It’s Al’s brother Nick, ensuring that the fried dough machine is working as intended so the San Roch unwashed masses can indulge in a time-honored San Roch tradition: eating orbs of dough fried in oil brushed with butter and smothered in powdered sugar (insert smiley face). As Nick wipes away his well-earned, sweat-drenched brow, I tempt him with the same question I gave brother Al: What does the Feast mean to him? “That’s an honor and I’m flattered you REVOCATION OR AMENDMENT OF A REVOCABLE TRUST When dealing with asset proM assachusetts General Laws Chapter 203E, Section 602 deals with the revocation or amendment of a revocable Trust. Unless the terms of a Trust expressly provide that the Trust is irrevocable, the Settlor (also known as the Grantor or Donor) may revoke or amend the Trust. Each Settlor may revoke or amend the Trust with regard to the portion of the Trust property that is attributable to that Settlor’s contribution to the Trust. Upon revocation or amendment of the Trust by fewer than all of the Settlors, the Trustee shall promptly notify the other Settlors of the revocation or amendment. The Settlor may revoke or amend a revocable Trust by complying with and following the provisions contained in the Trust regarding revocation and amendment. If the provisions of the Trust do not provide a specific method, the Settlor may revoke or amend the Trust by any method manifesting clear and convincing evidence of the Settlor’s intent. Upon revocation of a revocable Trust, the Trustee shall distribute the Trust principal pursuant to the direction of the Settlor. A Settlor’s powers with respect to revocation, amendment or distribution of Trust principal may be exercised by an attorney in fact under a Durable Power of Attorney only to the extent expressly authorized by the terms of the Trust itself and the terms of the Durable Power of Attorney. A Trustee that does not know that a Settlor has revoked or amended the Trust shall not be liable to the Settlor or the Settlor’s successors in interest for distributions made and other actions taken on the assumption that the Trust had not been amended or revoked. tection for MassHealth eligibility purposes, if you want the Trust assets to be considered a non-countable asset, the Trust instrument must state that it is irrevocable and the Trust instrument must be abundantly clear throughout all of its provisions that the Settlor or Settlors of the Trust cannot receive any principal distributions under any circumstance. This is referred to as the “any circumstances” test. An asset placed into a revocable Trust will be considered a countable asset for MassHealth eligibility purposes. Even if your home is placed in a revocable Trust, for it not to be deemed a countable asset, you would have to transfer the home out of the Trust into your name only. However, even if you might then be eligible for MassHealth benefits, the Estate Recovery Unit would place a lien on your home if you are single. If you are married and your spouse is still living in the home, a lien cannot be placed on the home. Joseph D. But I think I’ll defer to brother Al, not much I can add to his comments other than the honor of it being my first year wearing a ‘Trustee Chain’ in the footsteps of my namesake and godfather Nicky (Angelo). The energy of this weekend embodies everything being from Edgeworth is all about and hopefully we can celebrate for many years to come.” Perfect Nick, thanks for all you and your family do. Postscript 3: A Trustee Chain is worn by those walking the Procession honoring and recognizing the valuable contributions that a family has made over the many years of San Roch’s existence. Postscript 4: Next year on Pearl Street. Health and happiness till we meet again. Salud, chindon! —Peter is a longtime Malden resident and a regular contributor to The Malden Advocate.
