TERMS & CONDITIONS OF SALE PAYMENT To apply for a credit account, please call 01270 212726 to request an application form. Accounts can be paid in the form of cheques, debit/credit cards and BACs payments. We accept the following cards: CONDITIONS OF SALE INTERPRETATION a) 146 b) In these conditions, ‘the Company’ means JFH Horticultural Supplies Ltd or any other subsidiary Company or agent authorised by them and ‘the Purchaser’ means the persons firm or company purchasing from or doing business with the Company. ‘the Goods’ means all products supplied by the Company to the Purchaser whether by means of sale, hire, rental or otherwise and the property of the Company as agents for another. b) GENERAL a) b) These conditions of sale should be read in conjunction with any special conditions included in the Company’s quotations. The Company reserves the right to accept or refuse any order given on the basis of its quotations and in the event of the refusal of any order no damages or expenses of any kind shall be payable by the Company. c) d) e) Any complaint about the goods supplied shall only be entertained by the Company if made within 3 days of delivery. Credit will only be issued on returns if delivery note number is quoted. Supplied products may vary subject to availability. PAYMENT a) The goods shall remain the property of the Company until paid for by the Purchaser and clearance of any funds but shall be at risk of the Purchaser as from the date of delivery. b) Value Added Tax will be charged where applicable in addition to prices shown. c) DELIVERY a) The Company shall not be responsible for delay in delivery owing to matters outside the Company’s control. INDEMNITY a) The Company shall not be responsible for any loss of any description incurred by the Purchaser as a result of failure or fault in the goods or for any damage or personal injuries or other losses, whosoever caused directly or indirectly by the Goods. All goods are sold subject to the following terms: Goods are not tested and no warranty is given or shall be implied that the goods supplied are suitable for any specific purpose. In the event of any claim, seller’s liability shall on no circumstance exceed the invoice price of the defective piece(s). The Company shall pass on to the Purchaser the benefit of any guarantees or warranties provided by the manufacturers of Goods and any rights vested in the Company under such guarantees or warranties are hereby assigned to the Purchaser without prejudice to the previous sub-clause. d) Any liability claimed against the Company shall be notified to the same within 14 days of the liability arising or shall be void and unforceable.
