A Message from the Executive Officer Dear HBRA Members, The May General Membership Meeting at Clarke in South Norwalk was a buzz with attendees honoring the Building Official of the Year. Builder News Hartford Courant CT weighs tougher building codes to combat climate change Somewhere there’s a long list of expectations and The homebuilding industry is taking a waitand-see approach to Gov. Dannel P. Malloy’s recent executive order directing state agencies to strengthen building codes in response to climate change. Homebuilders aren’t opposed to stronger codes where necessary, particularly in wind-prone areas along the coast, but want decisions based on sound research and cost-benefit analyses. Most importantly, they don’t want regulations that price customers out of the market, said Bob Hanbury, a longtime builder and co-owner of Newingtonbased House of Hanbury Builders Inc., which does residential remodeling and additions. Hanbury is active in the industry, including serving on committees for the International Existing Building Code and on the board of the Home Builders & Remodelers Association of Connecticut Inc. “The motives are good; we just want to make sure the outcomes are as good as the motives,” Hanbury said. In April, Malloy issued an executive order instructing the Department of Administrative Services, Department of Energy and Environmental Protection (DEEP) and the Insurance Department to work with the Office of the State Building Inspector to ensure that the next revision to the State Building Code contains standards that increase the resiliency of new and renovated homes and buildings. Malloy hasn’t proposed anything specific, but said measures to consider include sealing seams in roof decks to guard against water infiltration if shingles blow off; stronger tie-downs of roofs to building structures; and impact-resistant glass in high-wind areas. Many measures to make buildings more resilient are relatively inexpensive, he said. He also cited research that every $1 spent on resiliency measures can save $4 in insurance claims. The Insurance Institute for Business & Home Safety (IBHS) backed Malloy’s recommendations. The institute released a report last year on the progress of 18 hurricane-prone coastal states along the Gulf of Mexico and the Atlantic Coast in strengthening their residential building-code systems. Connecticut scored 88 out of a possible 100, ranking it fifth best among the 18 states, up from a score of 81 in 2012. Top-rated states have strong statewide residential building codes and regulatory processes for building officials, homebuilders and residential construction contractors, IBHS said. It evaluated 47 key data points to assess the effectiveness of states’ residential-building-code programs, including code adoption and enforcement; building official training and certification; and licensing requirements for construction trades that implement building code provisions, IBHS added. IBHS cited a study conducted by Texas A&M University on hurricane-related building requirements in Texas that found the benefits of adopting the code provisions exceeded the costs by a factor of 4.5 to 7. Builder News Documentation and Contracts: Keep It Clear and Simple By Dennis A. Dixon | April 19, 2016 | Pro Remodeler Three essentials to ensure clear, factual, and detailed paperwork for remodeling projects as it’s signed and dated by both parties. So make sure that any selections made are accompanied by the client’s signature. Any contractor trying to win a battle with a homeowner, say about the color and texture of their newly installed driveway, which the client is now claiming is incorrect, will have an uphill battle without documentation. Thirty-plus years of construction experience, combined with lessons learned from involvement as an expert witness in construction litigation, has taught me that in any remodeling project, clear, factual, and detailed paperwork is worth its weight in gold, and a thorough construction contract promotes professionalism, protects your profits, and boosts your efficiency because it minimizes or eliminates confusion and the need for explanation. 1] Document it: Any and all paperwork, documentation (photos, video, even sound recordings), and “signed” changes are paramount in a legal defense. Everything else is secondary, if allowed at all. Also, in a lawsuit, the professionals are deemed to be exactly that: professional. The clients (homeowners) are assumed to be innocent and in the right until proven otherwise. Anything signed is valid—even a change order written on the back of a torn, dirty, envelope, as long Tip: Keep signed, approved sample selections in a labeled file box. Note: Some states require certain codicils in construction contracts, such as force majeure or an estoppel clause. Check with your attorney about what is and isn’t required for your locale. 3] Define it: The contract should define and explain project conditions, leaving little, if anything, to interpretation. Contractual paperwork should spell out policies, procedures, facts, figures, options, billing methods, payments, and ways to resolve conflict or misunderstanding. Builder News This Skills Gap Is Hurting America’s Housing Market Chris Terrill | Fortune Magazine We’ve heard plenty about America’s skills gap across the tech industry, but a skills gap is also hobbling construction — and it’s delaying building projects, shrinking building inventories, and inflating the cost of homes and home-related projects. The knowledge and skills necessary to repair our toilets, install our furnaces and build our houses are dying on the vine. And, unless we want our grandkids growing up in primeval teepees, we need to work quickly to fix it. This trend has been building up for years. In the 1990s, the American educational system (no doubt with the best of intentions) discontinued vocational classes and began to encourage all students to pursue a four-year college degree, creating significant, if unintended, consequences. First, fewer students were exposed to career options in the skilled labor trades. Second, the profound emphasis placed on college-level education perpetuated the notion that skilled (i.e., blue-collared) labor entails physically demanding, yet mindless work. And third, industry succession responsibilities were transferred to business owners lacking the time and resources required to fully train and educate would-be workers. The shortage worsened in the years following the 2008 financial crisis, when the dark days of the housing crisis led the construction industry to lose more than 60% of its workforce to healthier industries, according to the U.S. Labor Statistics and Census Bureaus. That’s more than any other nonfarm industry in the United States.
